Anyone interested in the sale of alcoholic beverages within a commercial business in Colleyville must obtain (1) a Special Use Permit from the City Council, (2) a license from the Texas Alcoholic Beverage Commission and (3) a permit from the city of Colleyville. The process is summarized as follows.
Colleyville voters approved the following two Texas Alcoholic Beverage Commission (TABC) permits for the sale of alcoholic beverages within the City Limits. For a complete description of all TABC permits, click here. · MIXED BEVERAGE PERMIT (MB) Permit authorizes the holder to sell mixed drinks from unsealed containers and wine, beer, ale and malt liquor in containers of any legal size for on-premises consumption. · WINE AND BEER RETAILER'S OFF-PREMISE PERMIT (BQ) Permit authorizes the holder to sell for off-premises consumption only, but not for resale, wine, beer, and malt liquors containing alcohol in excess of one-half of one percent (1/2 of 1%) by volume and not more than 14 percent of alcohol by volume. In General 1. A city of Colleyville alcohol sales permit is required for any business involved in the storing, dispensing, selling, or serving of alcohol beverages in Colleyville. Colleyville issues alcohol sales permits for (1) on-premises consumption of mixed beverages or (2) off-premises consumption of beer and wine. 2. A TABC permit is required for any business involved in the storing, dispensing, selling, or serving of alcohol beverages in Colleyville. 3. The location where alcoholic beverages are to be sold or served must be located in a commercial zoning district and have a Special Use Permit approved by the City Council for alcohol sales. 4. The place of business must not be located within 300 feet of any church or public hospital, measured from front door to front door, or within 300 feet of a public school, measured from property line to property line. An exemption to this requirement may be approved by the City Council as a condition to a Special Use Permit. 5. For all on-premises alcohol permits, city ordinance limits the sales of alcohol beverages to 40% of all sales. Special Use Permit 1. Application for Special Use Permit for the sale of alcohol beverages is submitted to the Colleyville Community Development Department. State License1. The applicant for a state alcohol license must apply to the Texas Alcoholic Beverage Commission. The offices are located at 6800 Manhattan Boulevard, Fort Worth TX 76120. The TABC license and application process is entirely separate from the City of Colleyville permit process and may require the submittal of information that has already been provided to the City. The TABC issues a Wine and Beer Retailer’s Off-premise Permit or a Mixed Beverage Permit for restaurants in Colleyville. Restaurants are also issued a Food and Beverage Certificate. 3. The applicant is required to obtain approval from the City Secretary that the proposed location complies with city zoning requirements. It is the applicant’s responsibility to provide the appropriate forms prescribed by the TABC and scaled drawings showing the proposed location of the applicant’s business in relation to streets, property lines, the nearest church, public school or public hospital. City Permit 1. Initial Permit – All applicants for the initial city of Colleyville alcohol permit must submit a copy of a valid and current Texas Alcoholic Beverage Commission permit. A restaurant must also provide a copy of the TABC Food and Beverage Certificate. 2. Renewal Permit – All applicants for the renewal of the city of Colleyville alcohol permit must submit (1) a copy of a valid and current Texas Alcoholic Beverage Commission permit, (2) a restaurant must also provide a copy of the TABC Food and Beverage Certificate, and (3) a Colleyville Alcohol Beverage Sales Report and Affidavit (CV-243). |
